Terms & Conditions

1. Scope of Services
These Terms and Conditions apply to all technology consulting, digital organization, privacy support, troubleshooting, and related services provided by Nik Focht – Funxion (hereinafter “the Consultant”). Services may include, but are not limited to Separation Technology RESET, Complete Technology REVAMP, Specific Technology RENEW, Tech Issues REMOVED, technology assessments and recommendations, device setup and configuration, digital organization and optimization, privacy and security guidance, technology transitions, and follow-up support sessions. By booking a consultation, purchasing a service, or entering into a service agreement, the Client agrees to these Terms & Conditions.

2. Client Responsibilities
The Client is responsible for providing accurate information regarding their devices, accounts, subscriptions, digital services, and technology environment. The Client shall maintain access to relevant accounts, devices, and services necessary for the Consultant to perform the agreed work. The Consultant is not responsible for delays, limitations, or issues resulting from incomplete information, restricted access, third-party service providers, or circumstances beyond the Consultant’s control.

3. Privacy, Security, and Access
Client confidentiality is a core principle of all services. The Consultant will only request access to accounts, devices, or services when necessary to perform the agreed work. Access credentials shared during the engagement will be treated confidentially and will not be retained longer than required to complete the service. While the Consultant follows industry-standard privacy and security practices, the Client remains responsible for maintaining control of their accounts, passwords, authentication methods, and personal data.

4. Consultation Scheduling and Cancellation Policy
Consultation appointments must be canceled or rescheduled at least 24 hours in advance. Cancellations made less than 24 hours before a scheduled session, or failure to attend a scheduled appointment, may be charged at the full rate. If the Consultant must cancel or reschedule a session, an alternative appointment will be offered at the earliest reasonable opportunity.

5. Payment Terms
Services are invoiced according to the agreed service package, hourly rate, or project scope. Invoices are payable within 14 days unless otherwise agreed in writing. Payments may be made via Bank Transfer, Twint, or other agreed payment methods. Service packages are valid for six (6) months from the date of purchase unless otherwise specified.

6. Limitation of Liability
The Consultant provides recommendations, implementation assistance, and technical support based on information available at the time of service. While reasonable care is taken to protect data and systems, technology services inherently involve interaction with third-party software, hardware, networks, and online services. The Consultant cannot guarantee uninterrupted operation, complete security, or compatibility of third-party systems. The Consultant shall only be liable for damages resulting from gross negligence or intentional misconduct to the extent permitted under Swiss law. The Consultant shall not be liable for indirect, incidental, consequential, or economic losses, including but not limited to loss of data, service interruptions, account restrictions, loss of access to third-party services, or loss of business opportunities.

7. Data Protection
Personal data collected during the provision of services is handled in accordance with the new Swiss Federal Act on Data Protection (nFADP). Information provided by the Client will be used solely for delivering the agreed services, communication, invoicing, and legal compliance obligations. Client information will not be disclosed to third parties without consent unless required by law.

8. Intellectual Property
Any templates, checklists, recommendations, documentation, workflows, guides, or materials created by the Consultant remain the intellectual property of Funxion unless otherwise agreed in writing. The Client receives a non-exclusive right to use such materials for personal or internal purposes.

9. Legal Venue
These Terms & Conditions are governed by Swiss law. The exclusive place of jurisdiction is Zürich, Switzerland.
